healer Akhlaq Azeemi ("we" or "us"). We operate this site
to promote and sell products and services offered by us. Use of this site by you
signifies that you accept these conditions and therefore we will provide you
with access. We may modify these conditions at any time, so please always read
through the conditions of use whenever you access or use this site. If you do
not wish to accept these conditions at any time then you may not use this site.

1. Introduction

Terms and Conditions govern your relationship with www.Sufi-Knowledge.com
(the "Website",
"Sufi-Knowledge", "we", "our" or
"us") and all orders that you may place for Products offered for sale
by us (the "Products") at this Website. Please study these Terms
and Conditions thoroughly as they affect your rights and liabilities under the
law. If you do not agree to these Terms and Conditions, please do not use our
services or order from us.
1. Revisions
We
may revise these Terms and Conditions as and when deemed necessary. Please do
check for changes from time to time. If you do not agree with any of the
revised Terms and Conditions you may not order from us. These Terms and
Conditions were last updated on [6th Mar] 2011.
2. Registration with Sufi-Knowledge
2.1.
To be able to make full use of our services and shop with us you must register
or set up an account with us as per instructions on the Website. However, this
is not a credit account; you will have to make payment prior to delivery of
goods or in case of electronically downloadable products before you download.
2.2.
You may register with Sufi-Knowledge only if you are eighteen years of age or
above. In case of a business, the operator must be eighteen or above.
2.3.
It’s your responsibility to ensure that the details you enter on registration
or later are current, accurate and complete.
2.4.
You must update your personal and other details, as and when they change.
2.5.
Any personal and payment details provided by you are treated as strictly
confidential – for full details please see our Privacy Policy .
2.6.
After you have registered with us we shall send you a confirmation e-mail. You
should print or save this e-mail for your records. You should also print or
save a copy of these Terms and Conditions for any future reference.
3. Password Security
3.1
During the registration process you will be required to create a password. You
must never disclose or share this password with anyone. You will be responsible
for all activities that happen at the Website under your password. If it comes
to your notice or you suspect that someone else knows your password you should
notify us immediately through our Contact Us section. You should also change
your password in My Account section of the Website.
3.2.
If we suspect that your password is likely to be misused or cause a security
breach at the Website, we may ask you to change your password or we may even
suspend or cancel your account.
3.3.
An auto login facility can be enabled to avoid entering your details again and
again. If you decide to make use of this facility, you will remain liable for
all activities that happen to your account. We advise you not to use this
facility if you share your computer with other people.
4. Payment for Products & Services
4.1.
Your credit card and payment details are safely and securely held on our
system. Further details can be found in our Privacy Policy . The payment
will be taken immediately after you have placed the order even though the
products other than the downloadable items may not be delivered for several
weeks as they are custom made to your requirements by our suppliers abroad.
However, we have no control over how long it takes your bank to process the
payment.
4.2.
If for any reason, such as bank errors, the product(s) have been delivered but
the payment has not been received you agree to compensate us in full against
any and all reasonable costs and expenses (including legal fees) that we may
incur in obtaining payments due from you.
4.3.
In case your bank rejects a payment, you are not allowed to cancel or amend
your order through the Website until you have contacted us to arrange another
payment and that payment has gone through. If a payment has been rejected by
your bank, you will not be able to amend, cancel or add to your orders via our
Website.
4.4.
If you have chosen to pay by cheque we cannot guarantee when it will be
deposited by us in our bank and when the amount will be taken from your
account.
5. Purchases from Sufi-Knowledge
5.1.
Once you have set up an account with us you may buy our products and services
through our online catalogue and ordering facility. The facility and our
communications with you in relation to your orders will be in the English
language. Using the facility you may review your order and make any necessary
corrections and changes before submitting it to us and your submission of the
order will mean you confirm that you have made any such corrections.
5.2
Each Product and/or service you choose to buy by clicking 'Add to basket' is
added to a 'shopping basket' facility. You are given the chance to change the
quantity or delete an item in your shopping basket when you choose to 'check
out’.
5.3.
By submitting an order you enter into a contract with us to buy the items
(Products and/or services) from us; you cannot then withdraw or cancel your
order except as stated in paragraph 5.4.
5.4.
When you click ‘place order’ in the shopping basket order summary page, our
Website displays an order confirmation message. No order is accepted from you
until this message is displayed. A contract for our sale of Products or
services to you arises on our acceptance of your order.
5.5.
All Products are subject to availability. If we are unable to deliver an item
you have ordered, we may replace it with a reasonable substitute. You may
reject that substitute, and we will refund any amount paid for it.
5.6.
The price that we charge you for the Products will be the price stated by us on
the Website prior to you clicking the 'place order' button. All prices are in
GBP (£ sterling).
5.7.
Our products & services are meant for end user and are not for re-sale. You
are therefore not allowed to re-sell any of our Products and services.
5.8.
All prices for Products and services are inclusive of any applicable UK taxes.
However, you may have to pay your local taxes if you are importing to a
location outside UK mainland.
6. Shipping
6.1.
Your order will be posted to your address as contained in ‘your account’
section. Any changes to address details must be made before you place the
order.
6.2.
Your order for items that are in stock will normally be shipped within 3
business days. The delivery for UK orders may take up to 7 business days from
the date of shipment. International deliveries may take up to 14 business days
from the date of shipment unless there is a delay caused by customs. Your order
for out of stock items or for rings and pendants made to your requirements may
take up to 8 weeks for delivery as such Products are made by our suppliers
abroad.
6.3.
You must inspect the Products upon delivery or soon after delivery and notify
us immediately if you find any defects, using our Contact Us section. We
will replace or refund you for defective Products. We will not be liable for
any losses you may suffer as a result.
7. Exclusions
7.1.
It is your responsibility, at your cost, to obtain computer, internet
connectivity, telecommunications or other necessary equipment or services to
access the Website.
8. Availability of the Website
8.1.
We make no promise that our Website services will meet your requirements and we
cannot guarantee that the service will be fault free. If you notice a fault in
the service, please report it to us using our Contact Us section and we will
try to rectify the situation as soon as we can.
8.2.
Your access to the Website may sometimes be restricted due to repairs,
maintenance or introduction of new services. We will restore the service as
soon as possible.
9. Cancellation rights
9.1.
We reserve the right to suspend or cancel any accepted order or your
registration at any time if we deem that you are in breach of any of your
obligations under these Terms and Conditions.
9.2.
You have the right to cancel your registration with Sufi-Knowledge at any time
by informing us through our Contact Us section. If you do so, you must not use
our services anymore.
9.3.
The suspension or cancellation of your registration shall not affect your
and/or our rights or liabilities accrued to the date of suspension or cancellation
or any orders submitted by you prior to cancellation, and you will continue to
be bound by such orders.
10. Warranties and Liabilities
10.1.
Whilst we try to ensure that the contents of the Website or any other
promotional materials we publish or distribute is correct, we cannot accept
responsibility for any errors, mistakes and/or omissions contained therein.
Without prejudice to your statutory rights (see paragraph 11, below), we may
correct any inaccuracies and/or errors and we will not be responsible for any
such inaccuracies and/or errors or for the results ensuing from the use of such
information or for any technical problems you may experience with the Website.
10.2.
If the Products you purchased from us are defective or faulty you should notify
us in accordance with paragraph 6.3. We will examine the Products and, if we
agree that the Products are faulty or defective we will replace any such
Products or refund the price you paid for them.
10.3
The warranty in paragraph 10.2 above does not apply to faults or defects which
have been caused by your mishandling, misuse and/or neglect of the Products or
by accidents caused while the Products are in your possession.
10.4
We will not be liable to you by way of representation (unless fraudulent), common
law duty or under any express or implied term of the contract for:
any
losses which are not foreseeable by you and us when the contract for the supply
and purchase of the products is formed arising in connection with the supply of
Products and related services or their use by you;
Any
losses which are not caused by any breach by us; or
business
or trade losses (including, without limitation, loss of profits, loss of
goodwill, loss of reputation and loss of business).
10.5
Our entire liability is limited to and will not exceed the price you paid for
the Products in question.
10.6.
We shall not be liable for any delay or failure in the performance of our
obligations due to events beyond our control such as but not limited to adverse
weather, acts of God, strikes, civil unrest and supplier failure.
10.7. We shall not in any case accept returns of the following items:
10.7.1.
Custom-made jewellery - the jewellery
items that you ordered as per
your specifications.
10.7.2.
Publications - any printed books or
other printed material
10.7.3.
Downloadable products such as e-books,
solution to your problem
files
10.7.4.
Any massage oils, pastes, herbal or
other supplements
10.7.5.
Any items that you damaged by misuse or
mishandling by accident or
otherwise
10.8. Any returns that you make just because you changed your mind
without any fault in the product will incur a 15% re-stocking charge
10.9 All returns must be made to our postal address as given in
the Contacts section
11. Your statutory rights
11.1
If you are a consumer and not a business, the Sale of Goods Act 1979 applies,
which states that we have to supply goods to you which are fit for their
purpose.
11.2
Nothing contained in these Terms & Conditions affects your statutory
rights.
12. Applicable Law
12.1.
These Terms and Conditions shall be governed by and construed in accordance
with the laws of England.
12.2.
The English courts will have non-exclusive jurisdiction over any disputes
arising under or in relation to these Terms and Conditions.
13. Miscellaneous
13.1.
You may not assign, sub-license or otherwise transfer any of your rights under
these Terms and Conditions.
13.2.
If any provision of these Terms and Conditions is found to be invalid by any
court having competent jurisdiction, the invalidity of that provision will not
affect the validity of the remaining provisions of these Terms and Conditions,
which shall remain in full force and effect.
13.3.
The Contracts (Rights of Third Parties) Act 1999 does not apply to our
contractual relationship with you and thus no third party may claim any rights
under that contractual relationship (but this shall not affect any right or
remedy of a third party which exists or is available apart from that Act).
14. Amendments
We
may change, alter or update these Terms and Conditions from time to time. If
you do not wish to accept the new Terms and Conditions, you should not continue
to order from Sufi-Knowledge or use our Website. If you continue to use our
Website after the date on which the change comes into effect that will indicate
your acceptance of the new Terms and Conditions.
